According to the New York Times report, Spiro claims in the letter that Microsoft may have violated “several clauses” of Twitter’s developer agreement “for an extended period of time.” Elon Musk’s lawyer claims in the letter that Microsoft used Twitter’s APIs in some of its products, including Xbox, Bing and its advertising platform, without paying a stated fee, until last month.

The text of this letter states:
“Until last month, when Microsoft refused to even pay research rates for continued access to Twitter’s APs and content, the company implemented eight separate Twitter API applications for the following products that appear to be for At least five Microsoft products and services provided data and functionality.”
Microsoft spokesperson Frank Shaw also shared the following statement with The Verge:
“Today we heard from a law firm representing Twitter about our previous use of the company’s free API. We will investigate and answer these questions. We look forward to continuing our long-term cooperation with this company.”
The software giant also told The New York Times that it is not currently paying Twitter to use the data.

Spiro did not mention any legal action in his letter. Last month, however, Musk threatened to sue Microsoft because the company “illegally used Twitter data for training,” presumably referring to data used to train large language models used in chatbots Bing and ChatGPT is used.
